Terms of Service

1. Service description

Clapper Cast ("we", "us", "the Service") is a third-party tool that records publicly broadcast Clapper livestreams to MP4 video files for personal viewing by the requesting account holder. We are not affiliated with Clapper, Inc.

2. Eligibility & account

You must be at least 18 years old to use the Service. You're responsible for keeping your password secure and for all activity on your account. Notify us at support@clappercast.io if you suspect unauthorized access.

3. Acceptable use

You agree NOT to:

• Record any broadcaster who has explicitly asked not to be recorded.
• Redistribute, re-upload, or publicly share recordings of broadcasters who have not consented to redistribution.
• Use the Service to harass, defame, stalk, or otherwise harm any person.
• Use the Service to infringe any third party's copyright, trademark, privacy, publicity, or other legal rights.
• Attempt to circumvent quotas, payment gates, or rate limits.
• Automate, scrape, or load-test the Service without written permission.
• Use the Service to record content that is illegal in your jurisdiction (CSAM, non-consensual intimate imagery, etc.).

We may suspend or terminate any account violating these rules without notice or refund.

4. Subscriptions & billing

Pro subscriptions are billed monthly via Stripe and auto-renew until canceled. You can cancel any time from Manage subscription in your account; cancellation takes effect at the end of the current paid period.

Refund policy: we offer a full refund within 7 days of your first Pro charge if you've recorded fewer than 5 lives in that period. After that, charges are non-refundable except where required by law. Email support@clappercast.io to request a refund.

5. Recordings, retention & ownership

Recordings are stored against the recording user's account. Free-tier recordings are auto-deleted after 5 days; Pro-tier after 60 days. We make no guarantee against earlier deletion (server failure, account termination, takedown). You should download anything you want to keep promptly.

By recording a broadcaster, you assert you have a lawful basis to do so. The Service does not assign any copyright in the underlying broadcasts to you; you are recording for personal viewing only.

6. Copyright & takedowns (DMCA)

We respond to valid DMCA takedown notices. To submit one, see our DMCA page or email dmca@clappercast.io. Repeat infringers will have their accounts terminated.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific live will be successfully captured. Recording success depends on third-party platforms outside our control.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from the Service will not exceed the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold Clapper Cast harmless from any claim, demand, loss, or damage (including attorneys' fees) arising from your use of the Service or your breach of these Terms.

10. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time by emailing support@clappercast.io.

11. Changes to these Terms

We may modify these Terms; we'll update the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of United States, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located there.
